1. Agreement to Terms

By accessing or using Cherami ("Service"), operated by Redwood Digital LLC ("Company", "we", "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

Cherami provides end-to-end encrypted messaging services that allow users to share text and files securely. Key features include:

• Self-destructing messages with view limits and expiration times
• Zero-knowledge encryption (we cannot decrypt your messages)
• File sharing with automatic encryption
• One-time redirect links
• Optional password protection

3. User Responsibilities

You agree to:

• Use the Service only for lawful purposes
• Not upload or share content that violates any laws or regulations
• Not attempt to circumvent security measures or access others' data
• Not use the Service to harass, abuse, or harm others
• Take responsibility for maintaining the confidentiality of your message links
• Understand that lost encryption keys cannot be recovered

4. Prohibited Content

You may not use Cherami to share:

• Illegal content or content that promotes illegal activities
• Child exploitation material
• Malware, viruses, or malicious code
• Content that infringes on intellectual property rights
• Spam or unauthorized commercial messages
• Content that violates others' privacy rights

We reserve the right to remove content and suspend accounts that violate these terms.

5. Service Tiers and Limits

Free Tier

• Message expiration: 24 hours maximum
• File size limit: 10 MB
• Character limit: 140 characters

Paid Tiers (Whisper, Echo, Cipher)

• Extended expiration times (up to 30 days)
• Larger file sizes (up to 150 GB)
• Extended character limits (up to 100,000 characters)
• Priority support

6. Payment Terms

• Paid subscriptions are billed monthly
• Payments are processed by Stripe
• Subscriptions auto-renew unless cancelled
• Refunds are provided on a case-by-case basis
• Price changes will be notified 30 days in advance

7. Privacy and Security

Your privacy is paramount:

• We employ zero-knowledge encryption
• We cannot decrypt or access your message content
• Messages are automatically deleted after expiration

8. Intellectual Property

• The Service and its original content remain our property
• You retain rights to content you share through the Service
• You grant us limited rights to store and transmit your encrypted content
• Open source components are subject to their respective licenses

9. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We disclaim all warranties, express or implied, including:

• Merchantability and fitness for a particular purpose
• Uninterrupted or error-free service
• Security or accuracy of transmissions

Our liability is limited to the amount paid for the Service in the past 12 months.

10. Indemnification

You agree to indemnify and hold harmless Redwood Digital LLC from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

• We may terminate or suspend access immediately for Terms violations
• You may terminate your account at any time
• Upon termination, your right to use the Service ceases
• Encrypted messages will continue to expire normally

12. Governing Law

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Continued use constitutes acceptance of modified Terms.
